Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Cairn: Fatherhood mobile application (the “App”) and the website at https://www.withcairn.app (the “Site”), operated by [Legal Entity Name] (“Cairn,” “we,” “us,” or “our”). Please read these Terms carefully before using the Services.

1. Acceptance of Terms

By creating an account, downloading the App, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, do not use the Services.

2. Description of Service

Cairn is a companion app for fathers that offers personalized guidance, activities, journaling and memory-keeping tools, and AI-assisted support across the stages of fatherhood. The App is provided for general informational and personal-organization purposes, as described further below. Features, content, and availability may change over time as we improve the product.

3. Eligibility

The Services are intended for use by adults. You must be at least 18 years old, and using the App on your own behalf as a parent or guardian, to create an account or use Cairn. By using the Services, you represent that you meet this requirement. Cairn is not directed to, and should not be used by, children.

4. Accounts

You need an account to use most features of the App. You agree to provide accurate information when creating your account, to keep your login credentials confidential, and to notify us promptly of any unauthorized use of your account. You are responsible for all activity that occurs under your account.

5. Subscriptions & Billing

Some features of Cairn require a paid subscription. Subscriptions are sold and billed entirely through Apple’s App Store — Cairn does not directly process or store your payment card details. By subscribing, you agree to Apple’s own terms and conditions in addition to these Terms.

  • Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period.
  • Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period, at the price you agreed to at purchase (or an updated price we’ve disclosed in advance).
  • You can manage or cancel your subscription at any time through your device: open Settings > [Your Name] > Subscriptions on iOS and select Cairn: Fatherhood.
  • Any unused portion of a free trial period, if offered, is forfeited when you purchase a paid subscription, where applicable under Apple’s policies.

6. Refunds

Because subscription payments are processed by Apple, Apple is the merchant of record and handles all refund requests. Cairn does not have the ability to directly issue refunds for App Store purchases. To request a refund, please visit reportaproblem.apple.com or use the “Report a Problem” link in your Apple purchase history, and follow Apple’s standard refund process.

7. Medical Disclaimer

Cairn provides general informational and educational content about fatherhood and child development. It is not medical, psychological, or professional advice, and it is not a substitute for consultation with a qualified physician, therapist, or other licensed healthcare provider.

Never disregard professional medical or mental-health advice, or delay seeking it, because of something you read or received through Cairn. If you are experiencing a medical emergency, a safety concern, or a mental-health crisis, contact emergency services (such as 911 in the United States) or a qualified professional immediately.

8. Acceptable Use

When using the Services, you agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to our systems, other users’ accounts, or non-public areas of the Services;
  • Reverse-engineer, decompile, or attempt to extract the source code of the App, except as permitted by law;
  • Upload content that is unlawful, abusive, or infringes the rights of others;
  • Use automated means (bots, scrapers) to access the Services without our written permission; or
  • Interfere with or disrupt the integrity or performance of the Services.

We may suspend or terminate accounts that violate these terms, at our discretion, as described in “Termination” below.

9. Intellectual Property

The App, Site, and all associated content, features, design, and trademarks (including the Cairn name and logo) are owned by Cairn or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms. Content you create in the App — such as journal entries, notes, and photos you upload — remains yours; you grant us only the limited rights necessary to store, back up, and display that content back to you as part of operating the Services.

10. Third-Party AI Content Disclaimer

Certain features of Cairn, including the “Ask Cairn” assistant and personalized content suggestions, are generated with the assistance of third-party artificial intelligence technology. AI-generated content is provided for general guidance and informational purposes only. It may occasionally be incomplete, out of date, or inaccurate, and should not be relied upon as a substitute for professional advice. You are responsible for exercising your own judgment when acting on AI-generated content.

11. Limitation of Liability

To the fullest extent permitted by law, Cairn and its officers, employees, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, goodwill, or other intangible losses, arising out of or related to your use of, or inability to use, the Services — even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Services will not exceed the amount you paid us, if any, in the twelve months preceding the claim.

12. Disclaimer of Warranties

The Services are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or completely secure, or that any content — including AI-generated content — will be accurate or reliable.

13. Termination

You may stop using the Services and delete your account at any time (see Delete Account). We may suspend or terminate your access to the Services if you violate these Terms, or for any other reason at our discretion, with or without notice, to the extent permitted by law. Upon termination, your right to use the Services will immediately cease.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of [Governing Jurisdiction], without regard to its conflict-of-law provisions. Any disputes arising from these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in [Governing Jurisdiction], unless applicable law requires otherwise.

15. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date above and, where appropriate, notify you through the App or by email. Continuing to use the Services after changes take effect means you accept the updated Terms.
